Sens Markey, Udall, Blumenthal Call for FTC Investigation into Manipulative Marketing in Children’s Apps

Sens Ed Markey (D-MA), Tom Udall (D-NM), and Richard Blumenthal (D-CT) called on the Federal Trade Commission to launch an investigation into new evidence of manipulative marketing practices in apps directed at children. A new study recently published in the Journal of Developmental & Behavioral Pediatrics reveals numerous instances of children’s games using advertising techniques that appear to constitute unfair and deceptive practices under Section V of the FTC Act.

Sinclair Settles with Justice Department Over Sharing Ad-Sales Information

Sinclair Broadcast Group has agreed to a settlement with the Justice Department over the sharing of information between television-station owners that raised antitrust concerns. Sinclair said (there's been no announcement from the Department of Justice) the settlement doesn’t represent an admission of wrongdoing and doesn’t subject the company to monetary damages or penalties. Government officials discovered the alleged sharing of sales information during their review of Sinclair’s $3.9 billion proposed acquisition of Tribune Media. 

UK's Information Commissioner’s Office Finds Cambridge Analytica and Brexit Financier Misused Private Data

Britain’s Information Commissioner’s Office, which has been investigating the misuse of personal data by political campaigns, found that defunct political consulting firm Cambridge Analytica violated British law when it used improperly harvested Facebook data to aid Donald J. Trump’s 2016 presidential campaign, and would face a significant fine if it were not already in bankruptcy.

Who was trying to influence your vote in the midterm elections? On Facebook, it was not always easy to find out.  Political advertisers are required to fill in a field that says who paid for the message in your news feed, but that does not necessarily tell you who they or their backers are. Entities can write whatever they want in that field as long as it's not deceptive or misleading. A growing number of Facebook ads in the run-up to the election took advantage of that loophole to obscure or conceal the identity and political motives of who paid for them – and Facebook did not catch it.

Sens Warner, Klobuchar Urge Zuckerberg to Address Loopholes in Facebook’s Ads Transparency Tool

Sens Mark Warner (D-VA) and Amy Klobuchar (D-MN), authors of the Honest Ads Act, urged Facebook CEO Mark Zuckerberg to address significant apparent loopholes in Facebook’s ads transparency tool. While Facebook committed to implementing transparency measures similar to those that the Honest Ads Act would require, they are currently failing to carry out the basic disclosure and disclaimer provisions of the legislation. The major gaps existing in Facebook’s transparency tool could allow adversaries to exploit the platform with continued disinformation efforts.

Democrats, tech splurge ahead of midterms

Left-leaning groups are pouring money into online advertising on platforms like Facebook ahead of the midterms — and cash from Silicon Valley staffers is flowing to Democratic campaigns, according to recently released data. Donations to Democratic candidates from tech staffers, political action committees and outside groups is more than triple that of Republican candidates, $13.4 million to $3.7 million.

Without new laws, Facebook has no reason to fix its broken ad system

Facebook’s ads have been a source of frustration for lawmakers for years, especially in the aftermath of the 2016 elections when it was discovered that Russian influence agents were able to place political ads involving US politics on the platform. Bills have been introduced to hold these platforms accountable, such as the Honest Ads Act, and federal agencies have launched investigations, but everything so far has fallen flat.

Your Kid’s Apps Are Crammed With Ads

In apps marketed for children 5 and under in the Google Play store, there were pop-up ads with disturbing imagery. There were ads that no child could reasonably be expected to close out of, and which, when triggered, would send a player into more ads. Dancing treasure chests would give young players points for watching video ads, potentially endlessly. The vast majority of ads were not marked at all. Characters in children’s games gently pressured the kids to make purchases, a practice known as host-selling, banned in children’s TV programs in 1974 by the Federal Trade Commission.
