The Affordable Connectivity Program has 23 million participants nationwide—including 1.9 million households in New York State and nearly 1 million households in New York City. As broadband access becomes increasingly essential for connecting with education, employment, and services—and New Yorkers grapple with a widespread affordability crisis—New York can’t afford to reverse course on making broadband more affordable. Congress still has time to act in May to reauthorize funding for the ACP and New York’s congressional delegation should lead the charge.

The 2nd US Circuit Court of Appeals in Manhattan ruled recently that federal telecommunications law does not stop states from regulating broadband rates. This was in relation to a 2018 law passed by the State of New York that required internet service providers (ISPs) to offer low-income rate plans for as low as $15 per month. ISPs appealed the new law, and a US District Court issued an injunction against the law. The recent ruling overturned that injunction and puts the law back into effect.

Associations representing large and small broadband providers are presenting a united front in opposition to New York’s requirement that providers offer a low-income internet service for $15 a month. In a prepared statement, six telecommunications provider associations said they support efforts to connect all Americans to broadband and that they are “committed to providing affordable options and a variety of plans to meet every family’s needs.” They added, however, that they are “disappointed” by the Second Circuit Court of Appeals decision to uphold New York’s mandatory $15-a-month offerin

The Department of Commerce’s National Telecommunications and Information Administration (NTIA) has accepted New York’s Digital Equity plan. Using $2,178,650.00 from the State Digital Equity Planning Grant Program, New York created a plan aimed at addressing disparities in digital access, skills and affordability across the state.

The US Department of the Treasury announced the approval of more than $228 million for high-speed internet projects in New York under the American Rescue Plan’s Capital Projects Fund (CPF), which the state estimates will connect tens of thousands of homes and businesses to affordable, high-speed internet.

Governor Kathy Hochul (D-NY) announced that applications are now open for the $100 million Affordable Housing Connectivity Program, a partnership led by Empire State Development’s ConnectALL Office in consultation with New York State Homes and Community Renewal to design and install broadband infrastructure at 100,000 affordable housing units across New York State.

In November 2023, the Empire State Development’s ConnectALL Office released the draft New York State Digital Equity Plan and sought public comment on how New York will bridge the digital divide in the state.
