This Memorandum of Understanding (“MOU”) is entered into by the Federal Communications Commission and the Federal Trade Commission for the purpose of facilitating their joint and common goals, obligations, and responsibilities to protect consumers and the public interest. The Agencies recognize and acknowledge that each agency has legal, technical, and investigative expertise and experience that is valuable for rendering advice and guidance to the other relating to the acts or practices of Internet service providers. It is agreed that: 

The Federal Communications Commission's Office of Engineering and Technology opened a new docket seeking comment on ways to potentially expand Federal access to non-Federal—including commercial—satellite services. In recent years, the commercial satellite industry has undergone tremendous growth and innovation. Federal government agencies have increasingly sought to meet their satellite communications needs by using commercial satellite services.

This Public Notice seeks public input to inform the Federal Communications Commission’s required assessment of the state of competition in the communications marketplace in its upcoming Communications Marketplace Report (2024 Communications Marketplace Report) to Congress. Specifically, we seek data, information, and comment on a wide range of issues relevant to the state of competition in the communications marketplace as a whole.

The Federal Communications Commission's Wireline Competition Bureau announced that RiverStreet Communications of North Carolina has notified the FCC that it will not fulfill its commitment to offer voice and broadband service to certain census block groups (CBGs) within its Connect America Fund (CAF) Phase II auction supported service area in North Carolina. In addition, Cebridge Telecom LA and Cable One VoIP LLC d/b/a Sparklight have notified the FCC of their decisions to withdraw from the Rural Digital Opportunity Fund (RDOF) support program in all the CBGs covered by their authorized win

In the course of the Federal Communications Commission's Office of Economics and Analytics’ (OEA) review of George Ford's Regulation and Investment in the U.S. Telecommunications Industry, staff determined that the underlying data relied upon by the author of this study has been revised by the Bureau of Economic Analysis (BEA) since the author’s analysis and the corrected data changes the results. Staff submitted a link to the original BEA data used by Dr. Ford, a link to the revised BEA data, and a comparison Dr. Ford’s two baseline model regressions using the different data sets. 

The Federal Communications Commission announced the maximum partial reimbursement amounts for the Affordable Connectivity Program (ACP) benefits passed through to ACP households by providers who elect to claim reimbursement for the May 2024 service month. Absent additional funding from Congress, April 2024 will be the last month for which ACP households can receive the full ACP benefit. The maximum reimbursement amounts for May 2024 will be $14 for Non-Tribal Service, $35 for Tribal Lands Sevice, and $47 for the ACP Connected Device Benefit.

On February 28, 2024, ten entities filed a petition for rulemaking asking the Federal Communications Commission to provide an option for 5/5 megahertz broadband networks in paired 896-901 MHz and 935-940 MHz spectrum (900 MHz band).  In this Public Notice, the FCC's Wireless Telecommunications Bureau seeks comment on the Petition. In particular, the FCC seeks comment on whether existing rules would be sufficient to protect incumbent narrowband operations from interference, as well as whether those rules would be sufficient to protect operations in adjacent spectrum bands. 

On March 20, the National Telecommunications and Information Administration (NTIA) N. NTIA urged the Federal Communications Commission (FCC) to reinstate strong net neutrality rules. "The Commission should act to reinstate strong net neutrality rules," said NTIA's comments. "An Internet that is open, secure, and accessible to all is an Internet that drives innovation, economic growth, and the free exchange of ideas around the world." NTIA also emphasized that reclassification can further national security objectives.

The Federal Communications Commission reminds providers that May 2024 will be the last month for which providers will be able to seek reimbursement for the Affordable Connectivity Program (ACP) benefits passed through to ACP households.

The Federal Communications Commission's Wireline Competition Bureau (Bureau) and the Office of Economics and Analytics (OEA) announce the availability, under the terms of the 2023 IPCS Protective Order, of the preliminary Incarcerated People’s Communications Services (IPCS) Database (2023 IPCS Database). The FCC staff developed this database to help analyze data and other information that IPCS providers submitted in response to the Commission’s 2023 Mandatory Data Collection.
